These Terms & Conditions (“Terms & Conditions”), as well as any other applicable policies and guidelines located elsewhere on our website or social media platforms, state how you may use our content which comprises the DBMH Camp Online Course. These Terms & Conditions may change from time to time. When you purchase an Online Course you agree to comply with these Terms & Conditions. 

License Purchase The Online Course is a video offered only for online streaming, and your purchase of the Online Course grants you a non-transferrable limited license (“License”) to view the video Online Course in accordance with this License via access to a viewing platform, which may be via a third party website or mobile app. The License is granted only to the original purchaser and may not be transferred, assigned, or sub-licensed. DBMH may revoke the License in the event of violation of these Terms & Conditions. Accessing any Online Course without a License, or other than within the scope of the License, violates copyright laws. Certain Online Courses may be offered in conjunction with supplemental materials aside from the licensed video, such as a pdf download, or discount codes for other goods or services. Such supplemental materials outside the scope of the License may be governed by additional terms. The License may be considered a “life time” license for the purchaser. DBMH plans to keep the Online Courses available for streaming indefinitely, but can not guarantee how long it will maintain the Online Course available for streaming. The licensed purchaser may view the Online Course an unlimited number of times for as long as the Online Course remains available from DBMH for streaming.  

Under the License, you may: - access and view the Online Course yourself; - download and print supplemental materials, if any, for your own use;  

Under the License, you may not, among other things: - share any portion of the Online Course or downloadable supplemental materials with anyone else who has not purchased a License, including employees, partners, co-workers, and family members; - resell or trade your License or access information to the Online Course; - reprint, republish, or distribute any portion of the Online Course or downloadable supplemental materials; - reproduce or alter any portion of the Online Course or downloadable supplemental materials or other intellectual property owned by DBMH without prior express written permission from DBMH; - claim ownership in any of portion of the Online Course or downloadable supplemental materials, or incorporate them into any other work without prior express written permission from DBMH; - use the Online Course or any downloadable supplemental materials for an illegal or unlawful purpose.  

Availability & Compatibility After purchasing the License for the Online Course, you may view the Online Course as often as you like. The video may be streamed on devices which meet the following criteria: iOS 12 and higher, Android OS 6 and higher, Firefox 45 and higher, or Chrome 50 and higher, or Internet Explorer 11 and higher or Safari 10 (etc.).  

All of DBMH’s Online Courses are intended for users who are eighteen (18) years of age or older. Any purchase or access to any Online Course by anyone under age 18 is unauthorized, unlicensed and in violation of these Terms & Conditions. By purchasing, accessing or using the Online Course you represent and warrant that you are at least 18 years old.  

We want you to have easy and enjoyable access and strive to work with reliable platforms and vendors. If you have any questions or problems, please let us know right away by contacting our support team directly. The support desk can be reached at: support@dirtybootsandmessyhair.com! However, some technology issues for accessing the Online Course are outside of DBMH’s control and you may need to seek support from a third party provider, support@kajabi.com. You accept and acknowledge our lack of responsibility for possible interruptions in access.  

Satisfaction Guarantee DBMH is pleased with each of the Online Courses and expects you will be too. If you have any questions or problems, please let us know right away by contacting our support team directly. The support desk can be reached at: support@dirtybootsandmessyhair.com! We want you to be satisfied with your purchase BUT we also want you to give your best effort to apply all of the strategies in the course. We offer a 14-day refund period for purchases. To qualify for a refund, please send DBMH a copy of your completed workbooks, a 250 word essay about each Speaker's Class you've purchased explaining why the Online Course didn't help you in your business, submit proof that you did the work in the course before the fifteenth day after your purchase. All refund requests must be received within fourteen (14) calendar days of your initial purchase of an Online Course. If you have opted for DBMH’s installment payment plan, refund requests must still be made within fourteen (14) calendar days of your initial purchase of an Online Course. Please bear in mind, while DBMH or the Online Course content may reference certain possible results, the outcomes or results achieved based upon the Online Course will vary for individuals and DBMH cannot guarantee your success, either professionally or artistically. Any results claimed are not guaranteed nor necessarily typical.  

You agree your personal data, including workbook and essay, may be retained by DBMH for business archiving purposes. More information about DBMH’s privacy policy can be found here.  

The work that you need to submit with your request for a refund includes ALL of the following items: - Proof of completed Workbooks - Proof that you watched all the classes - 250 word essay (about each Speaker Class you purchased) why the Online Course didn't help you in your business - A live link to your Website and Instagram Page that shows consistent posting - Link to your "About Me" Page, Contact Page and Blog/Galleries Page reflecting the suggestions of our Speakers - Proof of active participation in the Facebook Group "DBMH Online Camp" - Sign up for a phone call and tell us what we can improve

 Please note: If you opted for a payment plan and you do not request a refund within 14 days, with the required coursework at the time of your refund request, you are required by law to complete the remaining payments of your payment plan. All refund are descretionary as determined by Dirty Boots & Messy Hair Limited.  

Recurring Payments DBMH has made purchase of the Online Course available through an installment payment plan. If you choose this option involving recurring payments, you authorize ongoing access by DBMH to your related, necessary financial information stored by third party financial processing parties (e.g. SamCart purchasing platform and Stripe or PayPal payment processor) until your final agreed payment is completed.  

Chargebacks DBMH offers a clear method for obtaining a refund, as described above. You agree to request a refund under the above Refund Guarantee terms prior to attempting a chargeback with your financial institution. In light of our efforts to provide excellent goods and services and our commitment to your satisfaction and opportunity for a refund, we will not agree to any chargebacks. DBMH will dispute any requests for chargebacks, and may take any lawful action to support the dispute. DBMH may present to any party investigating a disputed chargeback information regarding your access and these Terms & Conditions. Other action by DBMH may include reporting the incident to a credit agency, or other organization which tracks chargebacks or delinquent accounts. Such reporting may affect your credit rating. Information which may be reported may include your name, email address, order date and amount, and your billing address.  

Privacy Please review our Privacy Policy to inform yourself of our privacy practices which are incorporated into these Terms & Conditions. When you purchase or use DBMH’s Online Courses personal data and information may be sought and collected by DBMH.  

Personal Information & Purchasing and Use To purchase or use DBMH’s Online Courses, you may be asked to supply certain information relevant to the purchase including, without limitation, billing details such as your credit card number, the expiration date of your credit card, your billing address, and contact information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you supply for the purchase is true, correct and complete. By submitting such information, you grant DBMH the right to provide the information to third parties for purposes of facilitating the completion of purchases.  

DBMH reserves the right to refuse or cancel your order at any time for certain reasons, including but not limited to, product or service availability, errors in the description or price of the product or service, or error in your order. DBMH reserves the right to refuse or cancel your purchase if fraud or an unauthorized or illegal transaction is suspected. To access the Online Course, you may be issued a username and password during a registration and/or purchase process. You are responsible for maintaining the confidentiality of the password and account, and are responsible for all activities that occur under the password or account. As the License is limited to you, you may not share your access information with anyone. You agree to notify DBMH immediately at support@dirtybootsandmessyhair.com if you learn of unauthorized use of your Online Course access information. Access to the Online Course by anyone other than the Licensed purchaser will result in termination of the License.  

DBMH will take reasonable measures to prevent the loss or misuse of any information provided by you to DBMH. Unfortunately, DBMH is unable to guarantee a loss or misuse will not occur. 

DBMH’s Intellectual Property & Prohibitions Unless otherwise indicated, the Online Course is DBMH’s sole property and all audio, video, text, photographs, and graphics comprising the Online Course (collectively, the “Content”) and the trademarks, service marks, and logos of DBMH contained therein (the “Marks”) are owned or controlled by DBMH, and are protected respectively by copyright and trademark laws and various other intellectual property laws of the United States, European Union, and other jurisdictions. The Online Course is provided “as is” for your information and personal use only. No part of the Online Course, Content, Marks, or associated materials (e.g. pdf downloads) may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.  

DBMH’s trademarks may not be used in connection with any product or service without the prior written consent of DBMH. It is prohibited to bypass any measures used by DBMH, or a third party streaming service, to prevent or restrict access to any portion of the Online Course or the Content. You may not: (a) Circumvent, bypass, or otherwise interfere with security related features of the Online Course, including features preventing copying of any Content or ensuring limitations on access to the Online Course; (b) Engage in any automated use of the Online Course, such as data mining, robots, or other data gathering tools; or (c) Delete the copyright or other rights notices from any Content.  

Special-Access Social Media Purchasers of Online Course will receive an exclusive, non-transferrable option to participate in an invite-only social media community related to the DBMH Camp, such as a Facebook group (hereinafter “Social Media group”). Participation in the Social Media group is subject to these Terms & Conditions. Please note, the Social Media group is hosted on a third party’s platform (e.g. Facebook), and such party may have additional terms and conditions of use. Further, content posted to the third party’s platform is to some extent beyond the control of DBMH, and the platform’s privacy policy may differ from that of DBMH. You agree DBMH is not liable for the actions of the third-party platform. To participate in the Social Media group, you agree specifically: Declaration of Ownership of Uploaded Material You agree only to upload or otherwise share materials with the Social Media group, i.e. text, audio, video, images, or other materials (“uploaded material”) for which you own the copyright, and for which any individuals depicted have granted releases for their images to be distributed and commercially exploited in any medium in perpetuity without further compensation or credit.  

Media Release for Use DBMH appreciates participation in the community of the Social Media group benefits everyone. Further DBMH supports artists having the right to control their work and receive credit for it. That’s why DBMH wants to clarify that by sharing your work with the Social Media group you are granting DBMH certain rights to it. This includes material you spontaneously share as well as material that may be shared in response or reply to a communication from DBMH or another party. Namely, you agree DBMH has:  

 • the nonexclusive right to copy, use, perform, display and distribute text, audio, video, images, or other materials you upload to or otherwise share with the Social Media group (“uploaded material”), for any legitimate purpose, including but not limited to distribution by means of streaming or other technologies via the Internet, or distribution of audio or video files (e.g. podcasts), or inclusion on other platforms (e.g. website, Instagram) in perpetuity throughout the Universe; • the nonexclusive right to combine such uploaded material with other images, recordings, or printed matter in the production of motion pictures, television, sound recordings, still photography, or any other media; • the nonexclusive right to assign, transfer, or license the above rights to third parties (This includes, but is not limited to, DBMH licensing its interest for distribution, or DBMH’s assignment to a third party in event of a sale of the business.); the right to use your uploaded material in connection with marketing DBMH’s goods, services, and programs. • the right to use the uploaded material without credit to you, though DBMH will make reasonable efforts to provide credit where practical.  

You acknowledge and agree you will not now or in the future receive compensation in connection with DBMH’s exercise, if any, of the above granted rights. 

Termination If you breach the Terms, we may terminate the License or suspend your access to the Online Course without prior notice or liability. Your right to access, view or use the Online Course and participate in related special-access social media groups will immediately end at termination.  

You may also choose to terminate your License and end your access to the Online Course. If you so choose, please notify DBMH immediately at support@dirtybootsandmessyhair.com. Your voluntary termination does not relieve you of any outstanding payments, which will become immediately due and payable upon termination. You agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater. Any outstanding balances not settled within fourteen (14) calendar days of termination may be forwarded to a collections agency. You agree to pay all costs if the account is forwarded for collection, including but not limited to reasonable attorney’s fees and court costs.

Validity & Dispute Resolution If any term or provision of these Terms & Conditions shall be held illegal, unenforceable or in conflict with any law governing these Terms & Conditions, the validity of the remaining portion shall not be affected by such holding.  

Our failure to enforce any right or provision of these Terms & Conditions will not be considered a waiver of those rights. These Terms & Conditions constitute the entire agreement between you and DBMH regarding the Online Course and supersede and replace any prior agreements there may be between you and DBMH regarding the Online Course.  

Any overdue fees not settled may be forwarded to a collection’s agency. You agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater. You agree to pay all costs if the account is forwarded for collection, including but not limited to reasonable attorney’s fees and court costs.  

Modifications and Interruptions DBMH reserves the right to change, modify, or remove the contents of the Online Course at any time or for any reason at its sole discretion without notice. However, DBMH has no obligation to update any information on the Online Course. DBMH also reserves the right to modify or discontinue all or part of the Online Course without notice at any time. DBMH will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Online Course. DBMH cannot guarantee the Online Course will be available at all times. DBMH, or its vendor(s), may experience hardware, software, or other problems or need to perform maintenance related to the Online Course, resulting in interruptions, delays, or errors. DBMH reserves the right to change, revise, update, suspend, discontinue, or otherwise modify the Online Course at any time or for any reason without notice to you. You agree that DBMH has no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Online Course during any downtime or discontinuance of the Online Course. Nothing in these Terms & Conditions will be construed to obligate DBMH to maintain and support the Online Course or to supply any corrections, updates, or releases in connection therewith.  

Changes DBMH reserves the right, at its sole discretion, to modify or replace these Terms & Conditions at any time. What constitutes a material change will be determined at DBMH’s discretion. By continuing to access or use the Online Course after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop accessing the Online Course.  

Assumption of Risk & Limitation of Liability You assume all risk of your purchase, access, and use of the Online Course and any supplemental materials. This assumption of risk includes any subsequent actions you choose to take due to the influence of or information obtained from the Online Course. In no event shall DBMH, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Online Course; (ii) any conduct or content of any third party on the Online Course; (iii) any content obtained from the Online Course; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
